This Terms of Sale outlines the terms and conditions under which "Minecraft-ServerList.com" ("Minecraft-ServerList", "our", "we", "us") sells services. It defines the rights and obligations of all parties involved in such transactions. These Terms of Sale are an extension of our general Terms of Service, which apply when using our platform. "Minecraft-ServerList.com" operates the website https://minecraft-serverlist.com to provide the Service described below.

1. Acceptance of Terms of Sale

By using or accessing Minecraft-ServerList.com or any subdomains, you agree to be bound by these Terms of Sale.

Purchasing any premium service from our platform constitutes full acceptance of these Terms of Sale. By making a purchase, you confirm that you meet the legal age requirement of eighteen (18) as defined by Dutch law or have explicit permission from a parent or legal guardian.

2. Prices

All prices are primarily displayed in United States Dollars (USD, $) by default but may also be displayed in Euros (EUR, €) or other currencies based on the visitor's location or preferences. Currency conversion rates are applied automatically, ensuring accurate pricing in Euros and other currencies where applicable. Unless specified otherwise, all listed prices include applicable government taxes and transaction fees.

We reserve the right to adjust prices for any of our services, including Premium Memberships and Featured Slots, at any time. Featured Slots may be priced at a fixed rate or offered through a bidding system. Specific pricing details will always be provided on the relevant service pages.

3. Premium Services

Minecraft-ServerList.com offers two distinct premium services: Premium Memberships and Featured Slots. These services are explained below.

The offered services are completely independent and must be purchased separately. Purchasing one does not automatically grant access to the other.

Featured Slots grant your server prominent placement on the front page or other high-visibility areas, ensuring maximum exposure to potential players. These slots may be priced at a fixed rate or acquired through auctions. Learn more.

Premium Memberships

Premium Membership provides exclusive benefits for your server which are not available for regular servers. These memberships are priced at a fixed rate. Learn more.

4. Premium Membership

Premium Membership unlocks exclusive benefits for your server, including increased visibility and access to features not available to regular servers. These benefits are designed to attract greater attention through a distinctive gold-themed design and the exclusive features provided with the membership.

Guarantee

When purchasing a Premium Membership, we guarantee that your server will receive all the benefits listed on the Premium Membership page at the time of payment for the duration of your membership.

Eligibility

All servers are eligible for Premium Membership. There are no restrictions or requirements based on server type, size, or status.

Duration

Premium Membership is sold on a weekly basis, with a minimum duration of 1 week and a maximum of 26 weeks. A server may hold an active membership for up to 26 weeks at any given time. Memberships can be extended as long as the total duration does not exceed the 26-week limit.

Renewal

Premium Memberships do not renew automatically. They must be manually purchased and extended by the server owner. A reminder email will be sent in advance to the email address associated with your account when your membership is nearing its end.

Banner Rotation

Servers with a Premium Membership are included in the premium banner rotation, which randomly features participating servers across key pages of our platform. This includes the homepage, all listing pages, and even individual server pages, with the exclusion of individual server pages of other participating servers.

In the event that a server is offline for an extended duration, it will be temporarily hidden from the premium banner rotation until it becomes active again.

Influencing Factors

The amount of traffic, clicks, or IP copies a server receives while having a Premium Membership is influenced by multiple factors. These may include, but are not limited to, the design of the server banner, server name, supported game modes, description, and overall platform traffic, which may fluctuate due to seasonal or daily patterns.

Performance may also be affected by the server's average player count. Servers with a lower average player count may not experience the same level of engagement as those with higher player counts. Access to Premium Memberships is not restricted based on player count; however, it should be understood that these memberships are intended to increase visibility and are not a guaranteed method for increasing traffic or player base.

While Premium Memberships are designed to enhance exposure, no specific amount of traffic, clicks, or engagement is promised or implied.

Featured Slots are designed to showcase your server across all listing pages on our platform, ensuring maximum exposure and engagement. These slots guarantee that your server will always appear in the purchased position during the placement period.

When purchasing a Featured Slot, we guarantee that your server will:

  • Be prominently displayed across all listing pages on Minecraft-ServerList.com.
  • Always appear in the purchased position for the duration of the placement, regardless of the online status of your server.

Only servers that meet the following criteria are eligible for a Featured Slot purchase:

  • The server has been registered with us for at least seven (7) days.
  • The server has a banner uploaded to our Service.
  • The server uses a custom domain without a port (e.g., play.awesome-mc-server.com) as its IP address.
  • The server has averaged 5 players or more online over the past 7 days, based on peak daily player counts.
  • The server does not already occupy an active Featured Slot.

The above criteria are subject to change at any time. If a server does not meet the current requirements, the exact criteria will be shown on the slot selection page.

Placement terms, such as the number of days your server will be featured, are clearly stated at the time of purchase.

Featured servers are not displayed on Cracked and Mod-pack pages unless they explicitly fall into these categories, such as being a Cracked server or featuring a Mod-pack.

6. Auction and Bidding

Auctions are a method for securing Featured Slots, offering server owners the chance to compete for premium placement. Each auction is structured to promote fairness, transparency, and equal opportunity for all participants. Please note that auctions may not always be active, in which case Featured Slots can be purchased directly, if available.

We reserve the right to modify auction rules, adjust slot availability, or implement additional measures to ensure a fair and efficient process.

Participation

By placing a bid in an auction, you agree to pay the full amount of your bid if you are among the top winning bids when the auction ends. Winning bids secure Featured Slots for the upcoming period. The number of available Featured Slots and the duration of the featured period are determined individually for each auction. Full details will be provided on the respective auction page.

Payment

Payment for winning bids must be completed within forty-eight (48) hours of the auction's conclusion. Failure to pay within this timeframe may result in the forfeiture of your slot and possibly the suspension of your account and the removal of your submitted servers.

Replacement Process

If a winning bidder fails to pay, the slot will be offered to the next highest bidder. The replacement bidder will also have forty-eight (48) hours to complete payment.

Currency Conversion

All bids are placed in USD by default. After the auction ends, winning bidders will have the option to complete their payment using other supported currencies. In such cases, the most recent exchange rate at the time of payment will be applied. Any additional currency conversion fees are the responsibility of the buyer.

7. Payments

Payments for all services must be made through PayPal, provided by PayPal Holdings, Inc., or other officially approved payment methods displayed on our platform. Payment details and instructions will be provided during the checkout process.

Authorization

By making a payment, you confirm that you are authorized to use the payment method or account provided. Unauthorized use of payment accounts is strictly prohibited and may result in the cancellation of services.

Receipt of Payment

Upon successful completion of the payment, a receipt will be emailed to the email address associated with your account.

Payment Processing

Services will commence only after payment has been fully processed and deemed final upon receipt of the full price. Delays in payment processing may impact the availability or start time of services.

Currency Conversion

Prices shown in currencies other than USD are converted using the most recent exchange rates available. However, final prices at checkout may differ slightly if the exchange rate changes at the time of purchase.

All payments made in non-USD currencies will be converted based on the current exchange rate at the time of the transaction. Any additional currency conversion fees are the responsibility of the buyer.

Suspension or Cancellation

We reserve the right to suspend or cancel services, regardless of their nature and level of performance, including but not limited to:

  • If payment is delayed, declined, or determined to be fraudulent.
  • If unauthorized use of a payment account is detected.
  • If the buyer violates our Terms of Service or these Terms of Sale.

If a service is suspended or canceled due to unauthorized use of a payment account, fraudulent transactions, or a filed chargeback, the associated account and server may also be removed from Minecraft-ServerList.com.

8. Refunds

Refunds are issued only in cases where the service provided fails to meet reasonable expectations due to extreme technical malfunctions or prolonged outage of the Service. Requests for refunds must be submitted within seven (7) days of the incident.

Eligibility

Refunds may be issued upon request under the following circumstances, and are evaluated on a case-by-case basis:

  • If there is an extreme technical malfunction or prolonged disruption of the Service, a partial refund may be issued. The refund amount will be proportional to the duration and severity of the disruption, as determined at the sole discretion of Minecraft-ServerList.com.
  • If a premium server is removed due to violations of our Terms of Service, Privacy Policy, or Terms of Sale, a refund may be granted for the unused portion of the premium service.

Processing

Approved refunds will be processed within fourteen (14) business days and issued to the original payment method and in the original currency used.

Administrative Fees

All approved refunds, with the exception of refunds due to extreme technical malfunction or prolonged disruption of the Service, are subject to a 10% administrative fee, deducted from the total refundable amount.

9. Applicable Law

These Terms of Sale and their interpretation are governed by Dutch law.

10. Changes to this Terms of Sale

We reserve the right to update these Terms of Sale at any time. Changes will be posted on this page and are effective immediately upon publication. We encourage you to review this page periodically and before initiating any purchase to stay informed of any updates.
